TCS to Appeal $194M US Ruling in DXC Trade Secrets Fight

Tata Consultancy Services (TCS) has received an unfavorable ruling from the United States Court of Appeals for the Fifth Circuit in its ongoing legal battle with Computer Sciences Corporation (CSC), now part of DXC Technology. In a disclosure dated November 21, 2025, TCS announced that the Appeals Court upheld the US District Court’s decision on damages but vacated the previously granted injunction. The ruling directs the Northern District of Texas, Dallas Division, to reassess the injunction based on the appellate instructions.

This development comes after TCS’s earlier communication on June 14, 2024, when the company informed stock exchanges that the District Court had ruled against it, holding TCS liable for $194.2 million. This total includes $56,151,583 in compensatory damages, $112,303,166 in exemplary damages, and $25,773,576.60 in prejudgment interest through June 13, 2024.

Despite the setback, TCS stated it is reviewing all available legal pathways, including further review and appeals before relevant courts. The company is committed to vigorously defending its position. It also clarified that appropriate accounting provisions will be made in its financial statements in accordance with applicable standards.

The case has its origins in 2019 when CSC filed a lawsuit alleging trade secret misappropriation by TCS. CSC claimed that TCS improperly accessed its software after several Transamerica employees who had licensed the software moved to TCS as part of a $2 billion deal. CSC argued this access enabled TCS to develop a competing insurance product, leading to the legal dispute.

This ongoing case underscores the complex legal challenges TCS faces related to intellectual property rights and corporate compliance. The company continues to evaluate its options carefully while maintaining its commitment to defending its reputation and interests in the legal proceedings.
